TERMS OF SERVICE

  1. 1. Definitions
    1.1 For the purposes of these terms and conditions the following definitions apply:

    • (a) Affiliates means any of our associated entities as that term is defined in the Corporations Act 2001 (Cth); 
    • (b) Our, ourselves, us, we, refer to Impressive Platters Pty Ltd trading as “Impressive Platters” (“Impressive Platters Corporate Catering”) and affiliates who, for the purposes of these terms and conditions, refer to any person or entity we directly or indirectly own, control or operate, currently or in the future and/or which has a controlling interest in us and/or is an entity who has the right to operate with or on behalf of ourselves;
    • (c) Terms and Conditions means these terms and conditions as amended from time to time;
    • (d) You or yours refers to you, the person accessing the Website and agreeing to the Terms and Conditions of your use of the Website and its contents.


    *Note in these Terms and Conditions, the single includes the plural and the plural includes the singular.

     

    2. Website and Social Media
    2.1 These Terms and Conditions govern your right to use the Impressive Platters Website, the Impressive Platters Social Media pages, and your access to and use of the Impressive Rewards Program and/or any products or services acquired in relation to the Membership Program and/or any links provided on the Website to other websites.

    2.2 In downloading any content from the Website and the Impressive Platters Social Media pages to your computer, you do not receive any ownership rights to such content and by downloading any content you agree not to use the content for any unlawful purpose and you agree that your use of the Website and the Impressive Platters Social Media pages is only for your personal use and not for any commercial or other use contrary to these Terms and Conditions and our legal rights in respect of the Website, the Impressive Rewards Program and the Impressive Platters Social Media pages.

    2.3 You agree that if you download any content from the Website and Impressive Platters Social Media pages, you will not reproduce, distribute in person, publish, republish, print, upload to any third party, post on any social media site or forum, or distribute or modify or otherwise deal with any content in the Website or the Impressive Platters Social Media pages in whatever format, personally or otherwise, and/or provide it, or any part of it, to a third party that would otherwise infringe our intellectual property rights.

    2.4 You agree that in downloading any service or product from the Website and the Impressive Platters Social Media pages, you will not rent, lease or lend it to a third party nor decompile, reverse engineer, modify or derive content from the Website and/or make it available over a network where it could be used by multiple devices at the same time.

    2.5 You agree that your use of the Website and the Impressive Platters Social Media pages will not violate any laws without limitation, including those governing competition, advertising, consumer protection laws, privacy, obscenity, spamming, stalking, intellectual property rights and/or defamation in Australia and when accessed in another jurisdiction the laws of that jurisdiction and Australian law, so far as the laws are not inconsistent, in which case you agree to be bound by the laws for Victoria, Australia.

    2.6 You agree that in using the Website and the Impressive Platters Social Media pages, you will not post threatening, harassing, defamatory, obscene, offensive, hate mail or speech or facilitate others to commit such acts in whatever format.

    2.7 You agree that you will not post comments about the Website or the Impressive Platters Social Media pages, any of their content, their individual representatives, officers, directors, consultants and/or employees without the prior written consent of ourselves.

    2.8 The content on the Website and the Impressive Platters Social Media pages, including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like and the trademarks, service marks and logos contained therein, are owned by or licensed to us, subject to copyright and other intellectual property rights under law.

     

    3. Your Agreement, Membership and Account
    3.1 In accessing, registering, or using the Website, including any and all webpages, your online account, the Impressive Rewards Program, the Impressive Platters Social Media pages, information, text and images offered or provided on the Website and the Impressive Platters Social Media pages, you are deemed to have read and personally agreed to the Terms and Conditions.

    3.2 We may offer promotional offers, member competitions and special discounts from time to time which will be subject to separate terms and conditions to be read in conjunction with these Terms and Conditions.

     

    4. Eligibility
    4.1 You represent and warrant that you are at least 18 years old and will be responsible for the information provided when creating an online account. If you are accessing and using the Website or registering for access to the Impressive Rewards Program or any of the Website's services or products on behalf of a party who is not at least 18 years of age then you are representing that you are that party's legal guardian and you are responsible for that party's compliance with these Terms and Conditions. You will indemnify us for any losses or damage that we suffer as a consequence of the party who is less than 18 years of age failing to comply with these Terms and Conditions.

    4.2 We have the right to refuse to deal with you, at any time, at our sole discretion, including the suspension or termination of your account, if we believe that you may or will bring our reputation, those individuals who represent us in the market place, our other users, and Impressive members into disrepute or otherwise will interfere with other parties' rights to have reasonable use of and access to the Website, the Impressive Platters Social Media pages or to the contents and components of the Website and the Impressive Platters Social Media pages or are in any way in breach of these Terms and Conditions.

     

    5. Payments
    5.1 In purchasing any product or Service from the Website ("the Purchase") you agree to:

    • (a) pay using a valid credit card (or other form of payment as we may allow, as detailed further below);
    • (b) provide us with current and complete information as detailed in the order form including full legal name, company name, company address, telephone number, company email address, credit card details and billing information as required and without limiting any of our rights and remedies if we discover or believe that any information provided by you is inaccurate or incomplete, we reserve the right to refuse to continue with your Purchases, or put on hold or terminate your access to the website, the Impressive Rewards Program, the Impressive Platters Social Media pages or any of the services or products provided by us at any stage at our sole discretion and you forfeit any right to a refund of any payment made by you for the Purchases;
    • (c) pay all costs, fees, charges, applicable taxes, surcharges and other charges as may be incurred in respect of the Purchases ("the costs"); and
    • (d) all costs are in AU Dollars.

    5.2 First-Time Orders:
    Your first order must be paid upfront by credit card or EFT may be accepted, if time permits, for events booked at least 72 hours in advance, depending on the size of your event.  Once your account is established, subsequent orders qualify for 30-day payment terms from the invoice date.

    • Major credit cards: VISA, Mastercard, American Express (AMEX), Diners

     Important Payment Information

    5.3 Surcharges:
    A 1.6% surcharge applies to VISA, Mastercard, AMEX and Diners card transactions. Surcharge rates may change without notice.

    Terms:

    • Notify us of any payment discrepancies within 24–48 hours of your invoice or order date.
    • All prices include GST and are subject to change without prior notice.

    By placing an order, you acknowledge and agree that prices may change without prior warning.

    We reserve the right to suspend services or hold orders if incomplete or inaccurate information is provided.

      5.4 You acknowledge and agree that prices are subject to change without prior notice. 

       

      6. Pricing
      6.1 All prices are in AU Dollars and are inclusive of G.S.T. All prices are subject to change without prior notice. 

       

      7. Cancellations:
      7.1 For orders fewer than 25 persons or under the value of $400: cancellations, reductions, or postponed orders must be confirmed by 11:00am one business day prior to the delivery date.  

      7.2 For all buffet meals: cancelling, reducing, or postponing must be confirmed by 11:00am, two business days prior to the delivery date.

      7.3 For whole celebration cakes, a 48-hour cancellation policy applies.

      7.4 For orders over 25 persons or over the value of $400: cancellations, reductions, or postponed orders must be confirmed two business days prior to the delivery date and there will be a 25% to 50% cancellation fee incurred.

      7.5 For orders over $1,000: cancellations, reductions, or postponed orders must be confirmed three business days prior to the delivery date and there will be a 50% cancellation fee incurred.

      7.6 For orders over $3,000: cancellations, reductions, or postponed orders must be confirmed five business days prior to the delivery date and there will be a 50% cancellation fee incurred.

       

      8. Equipment Pickup:
      8.1 All platters and equipment will be picked up in the afternoon of the following business day, unless otherwise advised.  

       

      9. Unreturned Equipment:
      9.1 Unreturned platters and equipment will incur a cost.

       

      10. Break Penalty for Personnel:
      10.1 A break penalty will apply if an individual works for more than five hours straight without a half hour break.  After the fifth hour, every hour thereafter will be charged at an extra cost per hour. 

       

      11. Allergens:
      11.1 Please note that our products may contain traces of products such as Nuts.  For further details, please view our Allergens page.

       

      12. Promotional Gift Cards and Early Bird Tokens:
      12.1 Order from the Impressive product range and you may be entitled to receive a gift card. If the promotion is running, invoices can be combined to receive a gift card. Each invoice can only be used once to claim an offer. This promotional offer must be requested upon placing your order/s. If you fail to request your offer upon placing your order/s, you will not be entitled to receive it. Claims for offers not received must be reported to the promotions manager within 7 days of the requested date, otherwise they will not be honoured. If you are a Registered Member of Impressive Platters, the invoice that you are claiming for will not be added to your points tally. These offers run during certain months of the year and cannot be used in conjunction with any other offers/promotions.       12.2 Place your order/s by 2pm at least one business day prior to your event to receive an Early Bird Token. Collect five tokens to receive a complimentary Cookie Jar of your choice!

       

      13. Delivery
      13.1 Delivery is free of charge as long as the total catering order exceeds $60 and the location of delivery is within the Melbourne CBD. A delivery fee will apply for outer areas, please check the delivery fee for your suburb using our Delivery Suburb Viewer on our homepage.

       

      14. Short Notice Requests
      14.1 Our customer service consultants will make every effort to assist you with Short Notice Requests. We appreciate that you may not always be notified in advance of forthcoming functions, which is why we will always do our best to help.  View our Express Menu for further details.

       

      15. Quotation Requests and Confirmations
      15.1 It is our responsibility to ensure that every effort is made to keep you, our valued client satisfied on every occasion.  Upon request, we can provide a listing of our recommended products and/or services, including prices, which may be suitable for your upcoming function.  

      15.2 You, the customer, may request a quote via one of the following ways:a) Fast over-the-phone requests with our customer service consultantsb) 24 hour requests for quotes via emailc) 24 hour requests for quotes via our websited) 24 hour call-back requests with our after-business-hours answering machine.

      15.3 Impressive Platters only accepts your confirmation of a quote once you have read, approved, and responded in writing confirming your acceptance. This may be done via return email, or by completing and faxing all pages of your quotation to Impressive Platters.

      15.4 Impressive Platters agrees to beat any quote provided to you by any other corporate catering company in Melbourne, by 20% or $100, guaranteed. If a quote is under $1,000, we will beat it by 20%; if a quote is over $1,000, we will beat it by $100.* 
      *In order to claim ‘Beat Any Quote’, you must provide us with a written copy of the competitors quote. This quote must include all details pertaining to a quote, including the goods and services required, and their corresponding prices. 

      15.5. You will have two opportunities to amend your quotation. From then onwards, we reserve the right to ask for a $5 service fee which will then be credited back onto your invoice once you place your order.  

       

      16. Privacy Policy
      16.1 Your privacy is important to us. Our Privacy Policy is incorporated into these Terms and Conditions by reference. Please read our Privacy Policy carefully for information relating to the collection, use, and disclosure of your personal information.       17. Our rights to modify services
      17.1 You acknowledge that we are entitled at any time, to change, modify, vary, delete or otherwise deal with the Website and the Impressive Platters Social Media pages, the Terms and Conditions, and/or our published material as we see fit.

      17.2 You agree that we may transfer, assign, license or deal with our interest in the Website, Social Media pages, copyright or any other published material to any Affiliate or to any third party who shall in any event be bound to meet the obligation of any agreement you have with us for products and services we provide to you for payment. 

       

      18. Jurisdiction
      18.1 These Terms and Conditions are governed by the laws of Victoria, Australia and you agree to the non-exclusive jurisdiction of the Courts of that jurisdiction and any appeals from those Courts.

       

      19.Indemnity
      19.1 You are liable for all content posted by you on the Website and the Impressive Platters Social Media pages.

      19.2 You are required to exercise due care to conform to any Australian laws relating to publication, broadcasting, media controls, advertising standards, and social media legal considerations, as they may arise or be applied to you in respect of any content you post on the Impressive Platters Social Media pages or in relation to the Website or that by your actions of conduct.

      19.3 You agree to indemnify us for any claims, losses, liabilities, costs or expenses ("losses") incurred by us you may cause, or contribute to such losses.

       

    20 - ASSIGNMENT
    You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

    21 - GOVERNING LAW
    These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the federal and state or territorial courts in the jurisdiction where Impressive Platters is headquartered. You and Impressive Platters consent to venue and personal jurisdiction in such courts.

    SECTION 22 - HEADINGS
    The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

    23 - CHANGES TO TERMS OF SERVICE
    You can review the most current version of the Terms of Service at any time on this page.
    We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
